My recent piece 'Clearing the docket: The role of neutrals in Pakistan and Judicial expectation herewith' was published in the Nation. This article highlights the importance of neutrals/mediators in any given legal ecosystem.
The need for mediators becomes a pressing matter for Pakistan in light of the enlarged case docket: estimated to be around 2.2 million currently. To entail efficacious and expeditious disposal of cases, the conventional court system may rely on help from mediation. The CIArb Pakistan Branch has contributed to the prospects of developing a pool of neutrals in Pakistan through their Globally Accredited Mediation Training in October 2022, which resulted in the accreditation and appointment of Pakistan's first set of neutrals.
This article aligns with the growing scope of mediation worldwide, which is further highlighted through the landmark judgement from the United Kingdom Court of Appeal in the case of Churchill v Merthyr Tydfil, where Mediation has become a necessary pre-requisite before resorting to courts.
